Unfair competition

What is unfair competition?

Unfair competition includes all activities of companies or organizations in economic competition that violate common decency. In many cases, the injured competitors suffer considerable damage. In the event of an infringement, we help you to conclusively prove allegations, investigate efficiently and provide evidence that can be used in court.

UWG includes, among other things:

  • impede the sales of a competitor
  • Systematically poaching employees
  • Aggressive and unauthorized sales methods (e.g. cold calling)
  • the unauthorized imitation of products or goods
  • misleading or untrue statements in advertising by competitors
  • comparative advertising to denigrate the competitor to consumers and customers
  • Damage to reputation
  • Infringement of patent rights

In most cases, the investigator’s costs can be claimed back from the injuring party as compensation in accordance with § 1295 ABGB.

We help you to clarify violations of the UWG in order to remedy any resulting competitive disadvantages and to assert any resulting claims for damages.
